   Maintaining confidentiality of data is extremely important for IQDENT sp. That is why we have prepared a privacy policy that describes the method of protection and processing of personal data provided to us in connection with visiting and using our online store at https://iqnails.pl.

 

Definitions

 

Online Store - Service Provider's online store at https://iqnails.pl

Service Provider or IQDENT - "IQDENT" LIMITED LIABILITY COMPANY registered by the District Court for Łódź -Śródmieście in Łódź, XX Department of the National Court Register under the KRS number: 0000584723, NIP: 7252103766, REGON: 362935470, share capital: PLN 5,000.00, ul. Kilińskiego 228, 93-124 Łódź, Poland, e-mail: sklep@iqdent.pl .

User - every entity visiting the online store or using the services available in it.

 

§ 1. What is personal data?

 

   According to the definition contained in art. 4 points 1 of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals in connection with the processing of personal data and in the case of the free flow of such data and repealing Directive 95/46/EC, published in Journal of Laws . "Personal data" means all information about the identified or identified by a natural person ("data subject"); Identified a natural person is a person who can be directly or indirectly identified, in particular on the basis of an identifier such as name, identification number, location data, internet identifier or one or several special factors specifying physical, physiological, genetic, mental, economic, cultural, cultural or social identity of a natural person.

 

§ 2. What are the legal grounds for data processing?

 

   The user's personal data is processed for purposes related to the implementation of the service that the user has ordered or intends to order. The given data will be processed on the basis of art. 6 para. 1 lit. b) and c) GDPR, as well as in accordance with the content of the general regulation on the protection of personal data, which means that such processing is necessary for:

  1. performance of the contract, whose parties are the user and iqdent or
  2. taking action at the user's request before the conclusion of the contract referred to in letter. and),
  3. Processing is necessary to fulfill the legal obligation of the IQDENT

The basis for processing may also be the legitimate interest of the administrator (Article 6 (1) lit. f) of the GDPR, which is also conducting direct marketing.

 

§ 3. Who is the administrator of users' personal data?

 

   The administrator of Users' data is IQDENT LIMITED LIABILITY COMPANY based in Łódź at ul. Kilińskiego 228, 93-124 Łódź, entered in the Register of Entrepreneurs by the District Court for Łódź-Śródmieście in Łódź, XX Economic Department of the National Court Register at the KRS number: 0000584723, having NIP: 7252103766 and REGON 362935470.

 

§ 4. Collecting personal data.

 

1. If the data processed by the Service Provider has been clearly reserved, include:

- name and surname,

- address of residence or company headquarters,

- correspondence address,

- e-mail address,

- contact phone number,

- NIP, PESEL, REGON,

- delivery address (if other than the address/ registered office).

2. Personal data is collected by the Service Provider during:

a.       enrollment for the newsletter,

b.      creating an account in the online store,

c.       placing orders,

d.      entries to the SMS database.

3. When making entries to the newsletter, personal data are collected by the Service Provider, such as: email address and contact phone number.

4. When completing the account registration form, such personal data as: name, surname, email address, telephone number, address data to issue an invoice are collected by the service provider;

5. When placing orders by users who do not have an account in the online store, such personal data as: name, surname, email, telephone number, address data for shipping the goods are collected by the service provider.

5a. During registration to the SMS database, personal data are collected by the Service Provider, such as: name, surname, address of residence, state of residence, email address, telephone number, and - optionally - the company name, NIP.

6. User data is collected:

  1. Automatically - data on your visits to the online store's website is automatically collected, e.g. your IP address, domain name, browser type, operating system type, etc.,
  2. When you contact us - when you contact us using a website, phone, email, etc. You provide us with your personal data, e.g. name, surname, email address, etc.

 

§ 5. Where are the user data stored?

 

   We store our personal data in the European Economic Area (hereinafter referred to as "EEA"). Each personal data transfer operation is performed in accordance with applicable law. Sometimes we will transfer some personal data of users to third countries, i.e. countries located outside the European economic area.

 

§ 6. Who has access to user data? Who do we entrust them with?

 

1. Users' data is available at IQDENT, and can also be made available to external entities supporting IQDENT or provide services supporting its activities, including IT services, accounting, legal, courier, postal, product marketing or audit. Data transferred to external entities are used only to provide us to users of our services.

2. With the consent expressed by the User, his personal data may be made available to entities associated with us and our business partners in order to conduct direct marketing of products and services of these entities.

3. In the case of inspection of the President of the Office for Personal Data Protection, Users' data may be made available to the office of the Office in accordance with the Personal Data Protection Act.

4. In the event of a violation of the regulations of our website, violation of law or when the law requires this, we can provide users with the users of the judiciary.

5. When we inform about individual categories of recipients, these are the following entities:

·         Hostinator: Cyber_folks  SA with headquarters in Poznań, ul. Wierzbięcice 1b, 61-569 Poznań .

 

·         Supplier of e-mail services: DHT-IT Jacek Żurkiewicz, ul. Gdańska 126/128, 90-520 Łódź.

·         Software Supplier for servicing invoices: INSERT SA, ul. Jerzmanowska 2, 54-519 Wrocław.

·         A provider of legal / advisory / debt collection services - these service providers are established individually in the event of each demand.

·         Electronic payment service providers:

o   PayPal s.à rl etie, SCA, Luxembourg;

O   Dotpay SA, ul. Wielicka 72, 30-552 Kraków,

O   InPost SA, ul. Pan Tadeusz 4, 30-727 Krakow

O   PayU SA ul. Grunwaldzka 186, 60-166 Poznań

·         E-commerce platform: The store uses the PrestaShop e-commerce platform to service orders, process customer personal data and manage the database. PrestaShop processes personal data to process orders, ensure a smooth purchasing process, as well as for marketing and communication purposes with clients. Personal data is secured in accordance with applicable law and the Privacy Policy available at https://prestashop.com/privacy-policy/

 

§ 7. What do we process user data for?

 

1. The data is processed in connection with the conclusion of contracts with users (in particular sales) and they are used during their duration, among others for the following purposes:

- implementation of legal obligations, including storage of data on electronic/postal correspondence for the needs of future claims or proceedings of authorized authorities,

- placing an order, conclusion and implementation of the contract between IQDENT and the User, including ensuring the correct quality of service

- investigations and defense against claims,

- other purposes arising from legal provisions.

2. Personal data collected when writing to the newsletter is collected to conduct marketing activities to users, including for analytical and statistical purposes.

3. Personal data collected when creating an account in the online store is processed for:

  • conclusion and performance of the contract for the provision of electronic services, i.e. enabling the User to use our website;
  • conclusion and performance of the sales contract (at a distance), the subject of which are goods available in our online store;
  • consideration of complaints that may be submitted in connection with the purchase of goods in the online store;
  • investigating or defending against claims arising from the conclusion of the abovementioned contracts;
  • conducting marketing activities of products and services, including for analytical and statistical purposes;
  • Contact with users, including for purposes related to permitted marketing activities, through available communication channels, in particular and with the consent of users - by e -mail and telephone;

4. Personal data collected when placing orders is processed for:

  • conclusion and performance of the contract for the provision of electronic services, i.e. enabling the use of the Online Store;
  • conclusion and performance of the sales contract (at a distance), the subject of which are goods available in our online store;
  • consideration of complaints that may be submitted in connection with the purchase of goods in the online store;
  • investigating or defending against claims arising from the conclusion of the abovementioned contracts;
  • conducting marketing activities of products and services, including for analytical and statistical purposes;
  • Contact with users, including for purposes related to permitted marketing activities, through available communication channels, in particular and with the consent of users, by e-mail and telephone.

 

§ 8. How do we use user data?

 

1. If you have enrolled in our newsletter or otherwise you have agreed to receive it, we will use your data to ship it. You will be asked if you want to receive a newsletter during registration. Data collected automatically can be used to analyze user behavior on our website, collect demographic data about our users, or to personalize the content of our websites. These data are automatically collected about each user. Above all, however, personal data is collected in order to provide the services we provide, which you order or intend to order.

2. Providing us with your personal data is fully voluntarily, but if you do not do it, you can not use our services or order them or receive a newsletter from the IQDENT portal.

3. We will process your data until the completion of the services provided to you, as well as after such implementation for the period allowing IQDENT to investigate or defend against claims for the use of our services, until their limitation, and until the obligations arising from tax and accounting regulations, or other generally applicable laws are fulfilled.

 

§ 9. What are your rights?

 

1. The user has the right to access his data and the right to demand it to rectify, delete or limit their processing.

  • Right access to data:

  You have the right to request information about which personal data we keep at any time. To do this, contact Iqdent.

  • Right to correct data:

You have the right to request the correction of your personal data if they are incorrect, as well as to supplement incomplete data by contacting IQDENT.

  • Right to delete data:

You have the right to delete any data processed by IQDENT at any time, except for the following situations:

- you have unfinished behavior with IQDENT,

- you have an open order that has not yet been completed or has been completed only partially,

- you have an unregulated debt to IQDENT, regardless of the payment method,

- your debt has been sold to an external company over the past three years,

- You have purchased any services, then we will keep your personal data on transactions for accounting purposes

  • Right to limit:

You have the right to request that IQDENT limits the processing of your personal data under the following conditions:

- if you do not agree to the processing of data based on the legitimate interest of IQDENT, then IQDENT will limit any processing of such data after verification, or there is such a justified interest,

- If you report that your personal data is incorrect, then IQDENT must limit any data processing until it is verified by their correctness,

- if the processing of data is unlawful, then you may not agree to delete personal data and instead demand limiting the use of your personal data,

- If IQDENT no longer needs your personal data, but they are required to submit or dismiss the claim.

2. To the extent of the basis for passenger processing is the performance of the contract or the user's consent - the User has the right to transfer the provided personal data to another administrator. When IQDENT processes your personal data in an automated manner, based on your consent or the concluded contract, you have the right to receive a copy of your data in the format that can be read. This applies only to personal data that has been provided to us.

3. To what basis for data processing, the administrator's legitimate interest is - the user has the right to object to the processing of his personal data at any time. You have the right to do not consent to the processing of your data. IQDENT's cessation of processing your personal data, unless we are able to find a lawful justification of this process that will annul your interest or right, or because of legal claims.

4. In order to exercise the rights referred to in para. 1-3 The user should contact the Administrator to sklep@iqdent.pl or by post to the address of the administrator's seat indicated above.

 

§ 10. The right to submit a complaint with the supervisory authority

 

   If you think IQDENT processes your personal data in the wrong way, you can contact us. You also have the right to submit a complaint in the supervisory body, which is the President of the Office for Personal Data Protection.

 

§ 11. How do we secure the user's personal data?

 

   Communication between your computer and our server, when we collect your personal data, is unacceptable. However, our databases are protected against insight of third parties.

 

§ 12. How can you exercise your rights?

 

   We have appointed employees who will answer questions about the above issues, and will also be responsible for ensuring compliance with the provisions of the GDPR, providing recommendations as to the assessment of the effects on data protection, as well as cooperation with the supervisory authority. § 13. Updates our Privacy Policy:

 

   In the future, it may be necessary to update the privacy policy. Its latest version will always be available on our website. We will inform you about any change in the content of the privacy policy, for example about changes in the purpose for which we use your personal data or your rights.

 

§ 14. Cookies

 

   Cookies are IT data, in particular text files that are stored on the user's end device, including websites and websites or applications. Cookies contain the name of the domain of the website from which they come, the time of storing them on the end device and a unique name. Information is stored in cookies that are often necessary for the proper operation of the website. A unique number can be stored in cookies that identifies the user's device but the user's identity is not determined on its basis.

   On the website https://www.iqnails.pl/ we use our own cookies: session and permanent. Own cookies are used to: maintain a basket and user session; remembering the language version and the country of delivery; remembering the reference code (from where the client came to us); remembering the data entered in the order form - form of delivery and payment, delivery address and invoice address; Remembering user preferences, e.g. sorting settings, or show him some messages, etc. We also use external cookies from the entities with which we cooperate, such as Google, Facebook, Instagram.    Due to the purpose of cookies and other similar technologies, we use their following types:

  • Necessary service and application- enabling the use of our services, e.g. authenticating cookies used for services requiring authentication;
  • files used to ensure security, e.g. used to detect abuse in the field of authentication;
  • performance - enabling information on how to use websites and applications;
  • Functional - enabling "remembering" the settings selected by the user and personalizing the user interface, e.g. in the scope of the selected language or region from which the user comes, the size of the font, the appearance of the website and the application, etc.;
  • advertising - enabling users to provide users with more adapted to their interests;
  • Statistical - used as counting statistics regarding websites and applications

 

   We also use tracking pixel (otherwise Web Bug), which perform a similar function as cookies, but are unrecognizable to the user. Traking Pixels is used by us to measure the user's behavior on the website, to ship the newsletter, to adjust offers in remarketing advertising. The data is anonymous and is not related to personal data on the user's end device or any database. To turn off Web Bug, when using our website, you can use e.g. tools such as Webwasher, Bagnosys or AdBlock. To disable Web Bug in the newsletter, change the postal program settings so that it does not display messages in HTML. Web Bug also does not work when messages are read in offline mode.

 

   In many cases, the software for browsing websites (web browser) allows you to store information in the form of cookies and other similar technologies on the user's end device by default. However, the user may change these settings at any time. Failure to change changes that the above -mentioned information can be posted and stored in its end device, and thus that we will store information on the user's end device and access this information. For example, it is possible to manage cookies from which the user uses, for example. In the most popular browsers, among others possibility:

  • accepting cookies, which allows the user to fully use the options offered by websites;
  • management of cookies at the level of single sites selected by the user;
  • determining settings for different types of cookies, for example, accepting fixed files as session, etc.;
  • blocking or removing cookies.

§ 15. Cookies of third parties

 

1. The use of third -party cookies is conditioned by the privacy policy and cookies used by this entity.

2.  We use cookies administered by Google Inc. 1600 Amphitheatre PKWy, Mountain View, CA 94043, United States as part of the services:

·         Google Ads - they allow you to conduct and evaluate the quality of advertising campaigns, carried out using Google Ads,

·         Google Analytics - they allow you to assess the quality of advertising campaigns, implemented using Google Ads, as well as to study the behavior and movement of users, and to prepare traffic statistics.

   Collected by Google Inc, they are anonymous and collective. In particular, they do not contain identification features (understood as personal data) of store users. Using the services listed, we collect data such as sources of acquiring users visiting the store, as well as the way they are preserved on the store's website, information on the devices and browsers they use, IP address, domain, demographic data (age, gender), interests and geographical data.

§ 16. Ads

 

   If the personalization of ads is enabled, Google will use your data to adapt the ads to your needs. For example, an online store with mountain bikes can use Google advertising services. After visiting this page you can see mountain bikes on other pages that show advertisements displayed by Google.

   If the personalization of ads is disabled, Google will not collect or use information about you to create an advertising profile or personalize the displayed ads. The ads will be displayed, but they will not be adapted to your needs. They can be related to the topic of the site you are browsing or application, currently searched passwords or your overall location, but not with your interests or search or browsing history. Your data can still be used for other purposes listed above, e.g. to measure the effectiveness of advertising and protection against fraud or abuse.

   When using a site or application that uses Google services, you can see the question of whether you want to watch personalized ads displayed by various companies, including Google. Regardless of the selected option, Google will not personalize ads if you have disabled advertising personalization setting or if the function of displaying personalized ads does not include your account.
